1. Definitions
Plain English
Where you see any terms as set out in clause 1 used in the main body of the Terms, they shall have the exact meanings given to them here.
Apolitical's Terms & Conditions
“Apolitical”, “We”, “Us” or Our means Apolitical Group Limited, a company registered in England and Wales with Company Number 09812036 whose registered address is at 20-22 Wenlock Road, London, N1 7GU;
“Academic Partner” means an institution or organisation that may grant academic degrees or other professional, vocational or educational certifications;
“Access Code” means the code provided by an organisation/ institution to an Institutional User allowing access to the Premium Services;
“Access Link” means the link provided by an organisation/ institution to an Institutional User allowing access to the Premium Services;
"AI Service Provider" means Open AI, LLC;
“Apolitical Content” means the data, text, files, images, videos, photos, profiles or material generated by and/or uploaded to the Service by Apolitical;
“Applicable Laws” means all applicable laws and regulations including local laws in your country of residence;
“Content” means data, text, files, images, videos, photos or profiles or other material uploaded via the Service;
“Groups” means a collection of multiple Users, and may include cohorts, communities or other groups who have access to a restricted part of the Service through membership of the Group;
“Individual User” means a User other than an Institutional User;
“Institutional User” means a User who has been granted access to the Services by an organisation/institution;
“Marks” means the Apolitical name, logo and service marks;
“Partner” means an individual, organisation or Academic Partner with whom Apolitical has a commercial, contractual and/or other relationship;
“Partner Content” means the data, text, files, images, videos, photos or profiles or other material created and/or owned by a Partner of Apolitical, to which Apolitical has a licence to upload on the Service;
“Platform” means the Website and platform hosted at https//:apolitical.co;
“Premium Services” means Content to which Apolitical charges a fee to access;
“Privacy Policy” means our privacy policy which can be found at https://about.apolitical.co/privacy-policy (as We may update such policy from time to time);
“Registration Data” means the information You provide to Us in order to become a User;
“Removed Content” means Content that Apolitical has removed, deleted or suspended from the Platform for any reason;
“Service” means accessing and interacting with our Website which is a multimedia website, publishing, educational and networking platform and email update service, all of which support professional social networking, collaboration and the sharing of information and ideas across government, public services and the public sector including uploading Content and downloading information as well as using any applications we may make available to You, and includes both the Standard Services and the Premium Services;
“Standard Services” means the part or parts of the Service which do not require payment from a User to access;
“User” means any registered user of the Service;
“User Content” means data, text, files, images, videos, photos or profiles or other material uploaded via the Service by a User;
“Website” means our website at https://apolitical.co
“You” or “Your” means a person using, or wishing to use, the Service.
2. Introduction

At Apolitical Our core value is ‘public service first’. We place paramount importance on maintaining Your trust, protecting Your personal data, and the quality of Our Service. These Terms set out how we expect Our Service to be used by Our Users. We will provide notice of any material updates to these Terms on Our Website, as well as via e-mail. - By using the Service You agree to be bound by these Terms and Our Privacy Policy as a User of the Service. If you do not agree to these terms, you must cease use of this website immediately.
- We reserve the right to update these Terms from time to time. If We make any material changes We will endeavour to notify You by email (sent to the email address specified in Your account) or by means of a prominent notice on the Website prior to the change becoming effective. An updated version of the Terms, once uploaded to the Website, will be effective immediately. If You do not agree with the Terms, You must stop using the Service immediately. If You have any queries about the Service or the Terms, You can contact Us using the details as set out in clause 15 of these Terms.
- You are responsible for making all arrangements necessary for You to have access to the Service. We cannot guarantee that the transmission of any information over Your internet connection will be secure nor can We guarantee that the Service will be compatible with any or all hardware and software that You may use to visit the Website.
- Access to, and the use of, some parts of the Service may be restricted to selected Users only (for example, owners or facilitators of groups or networks to control access to their groups or networks), and You may require their prior approval to join such groups or networks.
- We may, at Our sole discretion, (i) refuse to register You as a User (ii) limit access to all or part of the Standard Services to certain Users, or (iii) terminate the access of a User to the Standard Services, in each case without providing reasons for doing so.
- Although You register to use the Service as an individual, You are participating in Your work capacity. Therefore, please make sure that You are aware of, and comply with, Your employer’s (past or present) information and other policies regarding participating in collaboration platforms with access to social media tools.
- Further, by registering to use the Service You acknowledge and agree that You are doing so either wholly or mainly in connection with Your trade, craft, business or profession. You further acknowledge and agree that You are not registering to use the Service for any private use and that You understand consumer law will not apply to the contract formed between You and Us for Your use of the Service.
- The “plain English” explanations displayed next to these Terms are for information purposes only. They shall not form part of the agreement between You and Us, nor shall they have any contractual force or effect. Where any conflicts arise, the Terms shall prevail.
3. General terms in relation to conduct & use

Upon registering with Us, You agree that the service should not be used:
- For commercial gain without Our prior consent.
- For illegal activity or a means to gain unauthorised access to the system or networks.
- As a means to modify or adapt the pages comprising the Service.

a) By registering for the Service We grant You a non-transferable, non-exclusive, revocable, non-sub-licenseable licence to use the Standard Services through a generally available web browser, mobile device or authorised application, for Your personal use (albeit in connection with Your trade, craft, business or profession). The Service must not be used by You for any commercial gain without Our prior written consent. When You use the Service You must comply with these Terms and all Applicable Laws. In particular, but without limitation, You agree not to:
- use the Service in any unlawful manner, or in a manner which promotes or encourages illegal activity including (without limitation) violating and/or infringing the intellectual property rights of third parties including, but not limited to, the patent, trade mark, and trade secret rights of third parties; or
- attempt to gain unauthorised access to the Service or any networks, servers or computer systems connected to the Service; or
- modify, adapt, translate or reverse engineer any part of the Service or re-format or frame any portion of the pages comprising the Service, save to the extent expressly permitted by these Terms or by Applicable Law.
These Terms are binding on all Users even if You are using it on behalf of an organisation that has a separate agreement with Us.
b) If you are using the Service on behalf of an organisation, public authority, company or any other legal entity You are bound by these Terms, even if that organisation has its own separate agreement with Us. At such a time that the agreement expires or is terminated, if you continue to use this Service, you will be doing so under these Terms as an Individual User.
You must be 18 or over.
c) You must be at least 18 years old to use the Service.
You are responsible for the activity on Your account, including any Content You may post. Any Content may be subject to removal or editing. Removed Content may continue to be stored by Us to comply with legal obligations.
d) You are solely responsible for any activity that occurs through use of Your account with the Service. We may remove, edit, block, disable or monitor any Content or User accounts in relation to the Service at any time, without notice. Content removed from the Service may continue to be stored by Us, including, without limitation, in order to comply with certain legal obligations.
Should Your account be disabled, please ask Our permission before creating another.
e) If we disable Your account with the Service You will not create another one without Our permission. You use the Service at Your own risk.
We do not tolerate posts with discriminatory or defamatory Content on the platform.
f) You must not post violent, offensive, defamatory, abusive, vulgar, racist, threatening, discriminatory, unlawful, infringing, damaging or sexually suggestive Content via the Service.
You should ensure that Your account remains secure. You may be responsible for any Content posted from Your User account.
g) You must keep Your account and any relevant passwords or other means of access to the Service secure. We are not responsible for any Content that You upload or for any conduct of You as the User. Apolitical does not have any obligation to pre-screen or monitor, or remove any Content, however We may do so. If Your Content breaches these Terms, You may bear legal responsibility for that Content.
Should You suspect Your password is known by another person, contact Us immediately.
h) If You know or suspect that Your password has been disclosed to another person, You must immediately contact Us to let Us know and change Your password. We have the right to disable Your username and password at any time if in Our opinion We believe that Your account has been compromised or if You have failed to comply with any of the provisions of these Terms.
While We require all Users to present accurate information about themselves on the Service, We are not liable for false or misleading statements made by them.
i) Whilst we attempt to verify the identity of Users, You should not assume that the details of Users provided on the Service are accurate or complete. We are not liable for false or misleading statements made by any User.
We grant access to the service on the condition that You:
- Provide and maintain accurate information about Yourself;
- Post or use Content which complies with Our instructions and the Applicable Laws;
- Accept responsibility for all actions taken under Your User account;
- Do not create additional Users in order to abuse the Service;
- Do not seek to pass Yourself off as somebody else; and
- Do not intentionally allow another individual access to Your account.
j) We allow You to access to the Service as a registered User on the following terms, to which You agree:
- You must provide accurate, current and complete Registration Data;
- You may only use the Service to post, use or send Content and messages that comply with Our instructions and which are legal under Applicable Law and appropriate to the Service;
- You must maintain and promptly update the Registration Data, and any other information You provide to Us, to keep it accurate, current and complete;
- if You cease to work within the organisation which You indicated at the time of registration You worked for, You must immediately update Your Registration Data;
- You take responsibility for all actions taken under Your username and password;
- You must not create additional registered User accounts for the purpose of abusing the functionality of the Service or other Users;
- You must not seek to pass Yourself off as another person or User; and
- You must not intentionally or knowingly provide account access information, including any coupon codes, Access Codes, or Access Links, to another individual.
As a User of the service, You must not:
- infringe the legal rights or intellectual property rights of others;
- misrepresent Yourself or use the service for commercial purposes unless given Our prior consent;
- post any unsolicited advertising;
- post anything containing software viruses or similar malicious Content;
- use scripts to collect information or alter the Service;
- register for more than one account;
- post any personal or sensitive material concerning others; or
- share any confidential or sensitive information, nor any information subject to a non-disclosure or confidentiality agreement on the Service.
k) You must not do any of the following:
- use the Service to defame, abuse, harass, stalk, intimidate, threaten or otherwise infringe the legal rights (such as rights of privacy or intellectual property rights where applicable) of others;
- in using the Service, impersonate any other person or entity, whether actual or fictitious or falsely state or otherwise misrepresent Yourself, Your age or Your affiliation with any person or entity or use or attempt to use another User’s account;
- use the Service for commercial purposes unless We have given You Our prior written authorisation to do so, for which We may require You to pay a fee, and in particular You may not sell or advertise any goods or services on the Service unless We have first granted You a licence to do so and have received payment of the appropriate licence fee from You;
- use the Service to upload, post, transmit, share or otherwise make available any unsolicited advertising (although You may upload non-commercial events You think may be of interest to other Users acting in their professional capacity), unauthorised advertising, solicitations, promotional materials, “junk mail”, “spam”, “chain letters”, “pyramid schemes”, or engage in any other form of solicitation; upload, post, transmit, share or otherwise make available Content unless You are sure there are no restrictions (such as copyright) on Your ability to do so;
- use the Service to upload, post, transmit, share or otherwise make available any material that contains software viruses or any other computer code, corrupted files, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment; delete any required author attributions, legal notices or proprietary designations or labels in, or falsify the origin or source of, any material that is uploaded;
- use automated scripts to collect information from or in any way seek to change the Service or otherwise interact with the Service;
- register for more than one User account, register for a User account on behalf of an individual other than Yourself, or register for a User account on behalf of any group or entity; or
- share any sensitive, secret or confidential information, especially that obtained from a government service on the Service. This includes that pertaining to any government pending action or inaction or knowledge. You will honour any agreements, contracts or other legal obligations You have surrounding the non-disclosure of any official, confidential or sensitive information.
Your account may be deemed inactive and deactivated if it is unused for six months.
l) You should be aware that if You do not access the Service for a period of six (6) months or more, Your account will be deemed inactive and may be deactivated and deleted without any notice to You.
4. Content

The Service should be accessed at Your discretion. We are not liable for any Content which may be considered offensive – though please tell Us if You see any such Content. You can report questions and answers on the Q+A product directly, and to report other offensive Content please contact concierge@apolitical.co

a) You understand that by using the Service, You may encounter Content that may be deemed offensive. To raise a complaint about Content available on the Platform, please email concierge@apolitical.co or use the ‘Report’ function available on some Platform features. You use the Services at Your own risk and We shall not have any liability to You for Content You may find offensive.
It is Your responsibility to ensure that Content You post does not infringe upon the rights of any third party or breach any contract or arrangement You have with them. You must also ensure that Apolitical’s use of such Content does not violate any third party rights.
b) By using and posting Content to Our Platform, You represent and warrant that You possess all legal rights, titles, licences and agreements to do so and Your submission does not infringe any patent, copyright, trade mark, trade secret or intellectual property rights of any third party. Furthermore, by uploading Content to Our Service, You ensure and consent that Apolitical’s use, including publishing, distributing, editing, copying and holding of such Content does not violate any third party rights.
By publishing Content, you acknowledge that you waive moral rights. Where you are not the author of Content you have posted, you agree that you have obtained a waiver of moral rights from the author.
c). By uploading Content to Our Service, You acknowledge that You waive all moral rights. It is Our discretion to offer credit to any submissions You make, and additionally to transfer or to object to derogatory treatment of such Content. We also reserve the right to edit, delete, or merge Content with other submissions. Where You are not the author or creator of the Content, in publishing Content to Our Website You confirm that You have obtained a waiver of moral rights from the author.
Please note that any Content posted on the Service will be non-confidential and may be viewed by other Users. If you are an Institutional User consuming Content as part of a cohort, Content you share on the Service may be only visible to other cohort members. We are permitted to use any Content uploaded by You for any purpose.
d) Any Content posted by You on the Service will be non-confidential and may be viewed by other Users. Some Institutional Users access the Service via a cohort group, and there may be agreements in place to limit User Content accessibility to other members of the cohort. We are permitted to use, update, modify, view, analyse, copy, share, publish and re-publish any Content uploaded by You for any purpose.
Content on the Service is for information purposes only and should not be considered advice.
Apolitical does not warrant the accuracy or the quality of any Content posted on the Service and it should not be relied upon or considered to be advice. You are responsible for any decisions taken based on the Content of the Service. We are under no obligation to correct or remove inaccurate Content.
Whilst we work to maintain the quality of the Service, much of the Content on the Service is User generated so We cannot warrant the accuracy or quality of the Content posted.
Some Content has been generated by Artificial Intelligence (AI). Apolitical does not warrant the accuracy or the quality of this Content and it should not be relied upon or considered to be advice. We are under no obligation to correct or remove inaccurate Content even when such Content has been generated by Us. Where appropriate, We may indicate to Users where Content has been created by AI, however we do not warrant or represent that AI generated Content will be identified as such. Users may post AI generated Content throughout the site which may not be identified as AI generated.
e) Content on this Service is for information purposes only.
- Apolitical does not warrant the accuracy or the quality of any Content and it should not be relied upon or considered to be advice. We are under no obligation to correct or remove inaccurate Content. All information contained on the Website (including Content) is for information purposes only and (i) must not be regarded as constituting advice or recommendations (professional or otherwise) and (ii) should not be relied upon.
- Much of the information, data, text, software, photographs, graphics, messages, tags, ideas, concepts, forum posts, datasets, techniques and/or any other material on the Service is generated by Users. It may be out of date, inaccurate or incomplete, and We make no commitment to update or remove Content posted by any User. We do not warrant the accuracy, completeness, integrity or quality of any Content on the Service.
- Apolitical may use AI to wholly or partly generate information, data, text, software, photographs, graphics, messages, ideas, concepts, forum posts, datasets, techniques and/or any other material using information that is available on the Service and/or contained in the AI Service Provider's database (a "Dataset"). You are responsible for the information that you upload into the Service and the output generated by Your use of the Service is dependent on the quality and accuracy of Your input and the availability of Datasets. We do not warrant the accuracy, completeness, integrity or quality of Content generated by the Service or its suitability for Your intended purpose. Use of and reliance upon any Content on the the Platform and/or generated by the Service is at the User’s own risk
The Service contains Apolitical Content which is protected by intellectual property rights including, but not limited to, copyright, trade mark and patent. This Content must not be reproduced, modified or adapted, nor should the copyright, trade mark or patent be concealed or altered without prior written approval from Apolitical.
f) The Service also utilises certain Apolitical Content. Apolitical Content is protected by copyright, trade mark, patent, trade secret and other laws, and, as between You and Apolitical, Apolitical owns and retains all rights in the Apolitical Content and the Service. You will not remove, alter or conceal any copyright, trade mark, service mark or other proprietary rights notices incorporated in or accompanying the Apolitical Content and You will not reproduce, reverse engineer, modify, adapt, prepare derivative works, perform, display, publish, distribute, transmit, broadcast, sell, licence or otherwise exploit the Apolitical Content, other than as expressly permitted under these Terms or where you have been given prior written approval by Apolitical.
Apolitical works with Partners to develop Content which is protected by copyright, trade mark and patent to which the Partner owns the rights. Apolitical has a licence to use the Content on Our Platform. This Content must not be reproduced, modified or adapted, nor should the copyright, trade mark or patent be concealed or altered without prior written approval from Us and the owner. Unless otherwise specified, you are not granted any credits, rights or benefits from Academic Partners when you participate with content provided by an Academic Partner.
g) The Service also includes Partner Content. Partner Content is protected by copyright, trade mark, patent, trade secret and other laws. Our Partners may own and retain all rights in the Content that they licence Apolitical to use on the Service. You will not remove, alter or conceal any copyright, trade mark, service mark or other proprietary rights notices incorporated in or accompanying the Content and You will not reproduce, modify, adapt, prepare derivative works, perform, display, publish, distribute, transmit, broadcast, sell, licence or otherwise exploit the Partner Content, other than as expressly permitted under these Terms or where you have been given prior written approval by Us and the Owner.
Apolitical may co-develop content with Academic Partners. Unless otherwise specified, this content will not result in You receiving any academic credit from the Academic Partner, nor afford You any rights or benefits from the Academic Partner.
The Apolitical name, logo and service marks cannot be used, edited, published, distributed or commercially exploited without Our prior written consent.
h) The Marks are owned by Us. You are not permitted to use, edit, vary, display, publish, distribute, store or commercially exploit the Marks without Our prior written consent.
You are solely responsible for Your communications with other Users.
i) You may also be able to communicate with other Users through the Service and You acknowledge that You are solely responsible for those communications. We are not responsible for the behaviour, activities or opinions of any User
Other Users may use the ideas and information that You share via the service.
We are not responsible for other Users’ use (or misuse) of the Content You post. Please do not post any information You would like to be kept confidential.
j) The Service offers various ways for You to post Your observations and comments on designated topics. It also allows Users to share information by allowing them to post updates, including links to news articles and other Content to other parts of the Platform. Users can apply to create Groups; however, We may (in Our sole discretion) close or transfer Groups that have been inactive for a period of time, or remove Content if the Content breaches these Terms or infringes third party intellectual property rights. Ideas and information that You post and share may be seen and used by other Users. We cannot guarantee that other Users will not use the ideas and information that You share on the Service. Therefore, if You have an idea or information that You would like to keep confidential or do not want others to use, or that is subject to third party rights that may be infringed by Your sharing it, do not post, discuss or otherwise share it on the Service. We are not responsible for any other person’s misuse or misappropriation of any Content or information You post on the Service.
By posting Content on the service You allow Us to use, adapt and commercialise Your Content for any purpose.
k) By uploading Content on to the Service You grant Us (and Our agents, successors and assignees) an irrevocable, fully paid-up and royalty-free, perpetual licence (with the right to sublicense and to assign) to use, prepare derivative works of, improve, distribute, publish, reproduce, modify, adapt, remove, retain, add, process, analyse, use and commercialise Your Content via the Service in any way now known or discovered in the future for, whatever purposes Apolitical sees fit. This includes, but is not limited to, providing the Service to Users and promoting the Service.
Apolitical is not responsible for any third party services which might be accessible via links, images or functionality of the Service.
l) There may be links from the Service, or from communications You receive from the Service, to third-party websites or features. There may also be links to third-party websites or features in images or comments within the Service. The Service also includes third-party Content that We do not control, maintain or endorse. Functionality of the Service may also permit interactions between the Service and a third-party website or feature, including applications that connect the Service or Your profile on the Service with a third-party website or feature. You may be enabled to share Content from the Service, or Your Content, with a third party, which may be publicly posted on that third party’s service or application. Apolitical does not control any of these third-party web services or any of their content. You expressly acknowledge and agree that Apolitical is in no way responsible or liable for any such third-party services or features.
5. Premium Services for Individual Users

Apolitical offers a range of paid Content which Users may access for a fee. Content that requires payment to access will be clearly labelled with the price (excluding VAT and any additional charges) and currency. Apolitical will make reasonable steps to ensure that pricing information is kept up to date, and may adjust fees and pricing from time to time.
Where a User is purchasing content directly from the Platform, they will be directed to Our third party payment provider.
Apolitical offers refunds for Premium Services when they are requested within 14 days of initial purchase. For refund requests made after this period, please contact concierge@apolitical.co
Apolitical's Terms & Conditions
- This clause applies to Individual Users who wish to access Premium Services on the Platform.
- Apolitical will make reasonable attempts to maintain accurate and updated pricing information on Our Website. Prices shown on Premium Services are exclusive of taxes and other fees, including international currency exchange rates. At Our discretion, We may charge additional fees for content access.
- Apolitical reserves the right to change the pricing of Our Premium Services. Where You have previously purchased access to Premium Services, You will not be charged again unless You purchase another Premium Service or purchase via a different account.
- Payments made on Apolitical are facilitated by our third party payment processor. More information including about their data handling and terms of service can be found in Our Privacy Policy and in Our list of Third Party Processors.
- Payments must be made upfront in order to access the Premium Services. Apolitical reserves the right to remove access to Premium Services when full payment has not been received. This applies to payments processed via our third party payment processor, as well as via invoice.
- If You request a refund within 14 days of the date Your purchase was made, We will process Your refund and return payment via the initial payment method used. For further information, please contact concierge@apolitical.co
- Refunds requested after 14 days will be assessed on a case-by-case basis. You may be offered a refund, or credit to be used on another Apolitical product. For further information, please contact concierge@apolitical.co
6. Premium Services for Institutional Users
Plain English
Your access to Premium Services will end at the defined end date We have with your Institution. If Your Institution ceases to provide access to Premium Services before this date, We reserve the right to remove Your access to Premium Services immediately.

If You are an Institutional User, Your access to Premium Services will terminate on the termination date agreed with Your Institution. If your Institution terminates Your access prior to this date, Apolitical reserves the right to immediately terminate Your access to Premium Services at Our discretion. Under these Terms, You will cease to be considered an Institutional User and will instead be considered an Individual User once the termination date has passed, unless You delete Your account as described in Section 13.
7. Privacy policy

We take Your privacy very seriously. We will only use Your personal information in accordance with the terms of Our Privacy Policy. By using the Service, You acknowledge and agree that You have read and accept the terms of Our Privacy Policy and these Terms.
8. Disclaimer/liability

Please note that use of the Service is at Your own risk. Apolitical is not liable for any of the following damages arising through use of the Service:
- Technical failure
- Damage to Users or their equipment
- Economic loss
- Loss of goodwill, reputation or livelihood
- Losses derived through other means
- Actions of third parties (including the AI Service Provider)
Our liability is limited to a sum of £100, other than in the case of death, injury or any other liability which cannot be excluded by English law.
Apolitical's Terms & Conditions
- The Service and Content are provided on an “as is” basis, and to the maximum extent permitted by law, Apolitical makes no warranty or representation to You in relation to the Service.
- To the fullest extent permitted by applicable law, Apolitical excludes all implied or express warranties, terms and conditions relating to the Service (whether implied by statue, common law or otherwise), including (without limitation) any warranty, term or condition as to the merchantability, accuracy, completeness, performance, fitness for purpose or any special purpose, availability, non-infringement, information accuracy, interoperability, quiet enjoyment and title.
- The Service is operated by transmitting information via public telecommunication networks. We accept no responsibility for any technical failure of the internet and/or the Service; or any damage or injury to Users or their equipment as a result of or relating to their use of the Service. In addition, whilst we take the appropriate precautions to prevent the existence of malicious programs on Our Service, we accept no liability for them.
- Subject to clause 14.7, We accept no liability for any losses which arise out of or in connection with these Terms, use of Our Service, the Content, and/or User conduct. References to liability in this clause 9 include every kind of liability arising under or in connection with this agreement including but not limited to liability in contract, tort, (including negligence), misrepresentation, or restitution. The following specified types of loss are excluded:
- Any economic loss, direct or indirect (including, without limitation, loss of revenues, loss of profits, loss of contracts, loss of business, loss of data or loss of anticipated savings);
- Any loss of goodwill, reputation or livelihood;
- loss of use or corruption of software (including the Services), data or information;
- Any loss of opportunity; and
- Any special, indirect, incidental or consequential loss
- Apolitical is not responsible for the actions, Content, information, or data of third parties (including the AI Service Provider). You release Us, Our directors, officers, employees and agents from any claims, known or unknown, arising out of or in connection with any claim You may have against any third party.
- If Apolitical is liable to You directly or indirectly in relation to the Service, that liability (howsoever arising) shall be limited to £100.
- Nothing in these Terms shall be construed as excluding or limiting liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation or for any other liability which cannot be excluded by English law.
- These Terms also do not affect Your statutory rights.
- Consumer law will not apply to this contract.
9. Indemnity

You shall be liable to compensate Apolitical for any damages, including loss of reputation, suffered as a result of:
- A breach by You of these Terms;
- Content uploaded from Your account;
- A breach of law by You;
- Misrepresentation by You; or
- Any claim made against Us by a third party relating to Your use of the Service.

You shall indemnify Us against all liabilities, costs, expenses, damages or losses including direct and indirect or consequential losses, and all interest, penalties and legal costs (calculated on a full indemnity basis) and all other professional costs and expenses suffered or incurred by Us arising out of or in connection with
- a breach by You of these Terms;
- the enforcement of these Terms against You;
- the Content You upload or have uploaded from Your account;
- a breach of any Applicable Law;
- any misrepresentation or misstatement made by You; or
- any claim made against Us by a third party relating to Your use of the Service, howsoever arising.
10. Service suspension

Apolitical may modify, suspend or terminate any features, functions, content or other Services offered by Our Platform with or without notice at any time.

- Apolitical reserves the right to modify, suspend or cease providing the Service, or any services relating to the Service, with or without notice, and shall have no liability or responsibility to You in any manner whatsoever if it chooses to do so. We can limit Your access to the Service and/or the Platform at any time. Apolitical does not represent or warrant that the Service will be error-free or un-interrupted.
- We expect to provide updates to the Service, and to perform routine maintenance from time to time. This may involve a small period of time where the Service is unavailable. Service announcements will be notified on the Platform as far as it is possible to do so.
- In the event of unscheduled or emergency maintenance for security or any other reason, the Service may be unavailable for a period of time with no advance warning.
11. Advertisers on the service

We accept no responsibility for adverts (including the provision of any goods or services relating to adverts) contained on the Service. If You agree to purchase goods and/or services from any third party who advertises on the Service You do so at Your own risk. The advertiser, not Apolitical, is responsible for such goods and/or services and if You have any queries or complaints in relation to them, Your only recourse is against the advertiser.
12. Complaints

Please contact Us immediately if You have any complaints about the operation of the Service or:
- Believe that any Content has been uploaded wrongfully, illegally or accidentally;
- Are being harassed or bullied by another User; or
- Believe the Service is being used in a manner at odds with the law or codes of conduct.
We will take all reasonable steps to ensure the smooth and proper running of the Service for Our Users.

If You:
- have any complaints about the operation of the Service;
- believe that any images or Content have been uploaded to the Service wrongfully, illegally or accidentally;
- are being harassed or bullied by any other Users of the Service; or
- believe that the Service is being used by any person in any manner contrary to law or any applicable codes of conduct,
then please contact Us immediately at concierge@apolitical.co or use the ‘Report’ function available on certain products. We will take all reasonable steps within Our power to ensure the smooth and proper running of the Service, which may include, amongst other things, the removal of any inappropriate and illegal Content from the Service, termination of User access, or the reporting of misuse of the Service to the appropriate legal authorities.
13. Termination

We reserve the right to cancel Your membership and restrict access to the Service. These Terms shall remain in place even after termination.

- If You no longer wish to be a User, please use the User termination facility on the Service, or contact Us (using the contact details referred to in clause 15).
- If We believe that You have not complied with these Terms We may, at Our discretion and without incurring liability, cancel Your membership or subscription and restrict Your access to the Service immediately and without giving You any prior notice.
- On termination or expiry of Your membership or subscription, any provision of these Terms that expressly or by implication is intended to come into or continue in force on or after termination or expiry shall remain in full force and effect.

- We may assign or subcontract any rights or obligations under these Terms without Your consent. You may not assign or transfer any rights or obligations under these Terms without Our prior written consent.
- You are responsible for regularly reviewing these Terms so that You are aware of any changes to them and You will be bound by any updated Terms. No other variation to these Terms shall be effective unless in writing and signed by an authorised representative on behalf of Apolitical.
- If any provision(s) of these Terms is held by a court of competent jurisdiction to be invalid or unenforceable, then such provision(s) shall be construed, as nearly as possible, to reflect the intentions of the parties (as reflected in the provision(s)) and all other provisions shall remain in full force and effect.
- Apolitical’s failure to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision unless acknowledged and agreed to by Apolitical in writing. No single or partial exercise of such right or remedy shall prevent or restrict the further exercise of that or any right or remedy.
- Unless otherwise expressly stated, nothing in these Terms shall create any rights or any other benefits whether pursuant to the Contracts (Rights of Third Parties) Act 1999 or otherwise in favour of any person other than You and Apolitical.
- These Terms, and any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with these Terms, shall be governed by and construed in accordance with English law and You agree to submit to the exclusive jurisdiction of the English courts.
